UM, A PACE PROGRAM IS, UH, A PROGRAM THAT PROVIDES WRAPAROUND SERVICES FOR, UH, FRAIL ELDERLY SENIORS THAT WOULD OTHERWISE QUALIFY FOR NURSE NURSING HOME CARE, AND ALLOWS THEM TO BE ABLE TO STAY AT HOME AND THRIVE IN THEIR COMMUNITIES.

UM, WE HAVE SPENT, UH, ALMOST A FEW YEARS LOOKING FOR AN OPPORTUNITY TO BUILD A FACILITY HERE IN WEST COVINA AND HAVE BEEN REALLY THRILLED WITH THE OPPORTUNITY HERE AT 7 0 2 NORTH AZUA.

UH, JUST TO ORIENT YOU, IT'S AT THE CORNER OF AZUA IN EAST PUENTE, JUST WEST OF THE HIGH SCHOOL AND CADDY CORNER TO THE SHOPPING CENTER THAT HAS THE BIG LOTS AND THE DENNY'S.

UM, IT WAS FORMALLY OPERATED AS A CVS, BUT IT'S BEEN VACANT FOR A COUPLE YEARS NOW.

UM, AND WE'RE JUST REALLY EXCITED ABOUT THE SITE.

THE ACCESS IS GREAT.

SO, UM, I, I MENTIONED WE'VE HAD A COUPLE YEARS LOOKING FOR FACILITY AND WE'VE SPENT THE LAST COUPLE MONTHS PREPARING A PACKAGE TO COME TO THE PLANNING COMMISSION TONIGHT.

UM, HOPEFULLY WE'RE SEEKING APPROVAL AND HOPEFULLY YOU GUYS APPROVE IT.

AND THEN WE WILL QUICKLY TRY AND, UH, UH, SUBMIT FOR BUILDING PERMITS SO THAT WE CAN START CONSTRUCTION IN THE NEXT COUPLE MONTHS AND DELIVER THE FACILITY, UH, AT THE END OF THIS YEAR, 2025.

UM, THERE ARE SOME NUANCES TO WHEN YOU CAN OPEN A PACE CENTER.

I WAS FAINTING.

I WAS DEHYDRATED.

AND, UM, 9 1 1 CAME AND THEY, YOU KNOW, BASICALLY TOLD ME I WAS DEHYDRATED AND THEY WANTED TAKE ME.

AND I SAID, NO, IT'S OKAY.

IF THAT'S WHAT IT IS, I'LL JUST, I'LL GO TOMORROW MYSELF.

I'LL JUST, I DIDN'T, I WAS SO TIRED AND DEHYDRATED.

I DIDN'T WANNA BE THERE FOR FIVE OR SIX HOURS.

SO, UM, ANYWAYS, SO THEY LET, THEY GAVE ME, UM, UH, AN IV SALINE AND ACTUALLY I FELT MUCH BETTER.

I DIDN'T HAVE TO GO IN A WEEK LATER.

I HAD TO CALL AGAIN THIS TIME ACTUALLY IT WAS FOR MY SON.

MY SON WAS VERY, VERY ILL.

AND, UM, WHEN I CALLED THE 9 1 1 DISPATCH, THEY DID NOT WANT TO SEND ANYONE TO MY HOME UNLESS I COULD, UM, COMMIT TO LETTING THEM TAKE HIM TO THE HOSPITAL.

SO THEY DIDN'T WANT TO COME AND CHECK HIM OUT.

UM, I, I KNOW THAT THEY'RE UNDER CONTRACT.

I'VE HEARD OTHER RESIDENTS, UH, COMPLAIN ABOUT, UM, ISSUES AS WELL, UH, WITH THEM, NOT WITH DISPATCH, NOT WANTING TO, UH, SEND OUT, UH, THE FIRE DEPARTMENT OR, OR HELP THE RESIDENTS WHO ARE IN, YOU KNOW, IN DISTRESS AT THAT POINT.

NOBODY WANTS TO CALL 9 1 1.

UM, BUT I KNOW THAT THERE'S AN ISSUE THERE AND I WANNA KNOW IF THERE'S ANYTHING WE CAN DO TO LOOK AT THE CONTRACT OR TO FIND OUT, UM, YOU KNOW, I MEAN, I ENCOURAGE RESIDENTS TO, TO CALL AND I MEAN, WHO WOULD THEY CALL TO SPEAK WITH AND, AND MAKE A COMPLAINT? 'CAUSE I KNOW THERE ARE SEVERAL, THERE'S MANY OUT THERE THAT HAVE HAD A PROBLEM WITH THE DISPATCH STEP IN AND ASSIST.

I THINK A GOOD FIRST STEP WOULD BE TO LET OUR POLICE CHIEF KNOW, UM, POSSIBLY OUR ACTING FIRE CHIEF AND OUR CITY MANAGER.

I THINK THAT WOULD BE GOOD TO LET THEM KNOW WHAT YOU EXPERIENCED IN 20 YEARS.

I MEAN, , OTHER THAN WHEN MY, YOU KNOW, I HAD AN AUNT WHO WAS 95, WE HAVE TO CALL FOR HER, BUT FOR ME AND MY KIDS, WE'D NEVER HAD TO CALL.

CAN I EXPLAIN A LITTLE BIT FURTHER ON DISRUPTIVE BEHAVIOR? THE BROWN ACT WAS RECENTLY AMENDED AND THE GOVERNMENT CODE DEFINES WHAT DISRUPTIVE BEHAVIOR IS, AND IT IS DIS DISRUPTIVE BEHAVIOR UNDER THE GOVERNMENT CODE.

UM, WHICH THE BROWN ACT PARAGRAPH, THAT SECTION SAYS IT IS ENGAGING IN BEHAVIOR DURING A MEETING THAT ACTUALLY DISRUPTS, DISTURBS, IMPEDES, OR RENDERS INFEASIBLE THE ORDERLY CONDUCT OF THE MEETING.

SO IF THE MEETING CANNOT CONTINUE, OR IF THERE IS A DIRECT THREAT THAT WOULD BE A DISRUPTIVE BEHAVIOR THAT IS ACTUALLY DEFINED UNDER THE, THE GOVERNMENT CODE.

AND FOR THOSE ITEMS, THE CHAIR IS ABLE TO REQUEST THE SERGEANT OF ARMS, UM, TO REMOVE THE SPEAKER OR TO GO ON RECESS UNTIL ORDER IS RE RESTORED.

AND THAT IS AT THE DISCRETION OF THE CHAIR.

SO IF THERE IS A DISRUPTION, THE CHAIR CAN PAUSE THE MEETING UNTIL THE DISRUPTION SUBSIDES AND RESTORE ORDER, UM, AND CONTINUE THE MEETING AT THAT POINT.

SO WHEN THERE IS ACTION THAT DISRUPTS ACTUALLY DISRUPTS WHERE YOU CANNOT HEAR, YOU CANNOT CONDUCT THE MEETING.

I BELIEVE WE HAVE HAD ONE INCIDENCE BEFORE WHERE WE COULD NOT HEAR AND WE COULD NOT CONDUCT THE MEETING.

UM, SO, UM, THE BROWN ACT DOES ALLOW, UM, THE REMOVAL OF THE, THE DISTURBING PERSON WHEN THAT ACTION BECOMES TO THE POINT WHERE THE MEETING CANNOT CONTINUE IF YOU CANNOT CONTINUE.

BUT, UM, IF IT IS DURING PUBLIC COMMENT AND THE PUBLIC CAN SPEAK ON ITEMS THAT ARE, WHETHER THEY ARE AGENDAS OR NOT DURING THAT OPEN PUBLIC COMMENT, ANYTHING THAT IS WITHIN THE SUBJECT MATTER OF THIS PLANNING COMMISSION, THEY ARE WELCOME TO SPEAK AS LONG AS IT IS NOT ACTUALLY DISRUPTIVE OR A THREAT.

AND IF IT IS A DIRECT THREAT, UM, THAT IS DEEMED DISTURBING, UH, DISTURBING BEHAVIOR UNDER THE ACTUAL CODE.

SO IF THERE IS A THREAT MADE TO, UM, STAFF OR OTHER MEMBERS IN THE AUDIENCE OR TO THE COMMISSION, UM, THAT AT THAT POINT THE MEETING CAN BE PAUSED, STOPPED, AND THE SERGEANT AT ARMS CAN BE REQUESTED AT THE CHAIR'S, UH, REQUEST TO REMOVE THE PARTY WHO IS CAUSING THAT DISRUPTION.

AND IF THERE IS A FURTHER, UH, DISTURBANCE OF THE PEACE IN THE PRESENCE OF AN OFFICER, THAT WOULD BE A DIFFERENT MATTER AND THAT WOULD BE A CRIMINAL MATTER THAT CAN BE PURSUED BY THE SERGEANT AT ARMS, MEMBER OF THE POLICE DEPARTMENT WHO IS HERE TO ACTUALLY SEE THE OFFENSE HAPPEN.

AND I BELIEVE THAT WOULD BE, UM, EITHER AN INFRACTION OR MISDEMEANOR.

UM, BUT THAT WOULD BE A SEPARATE DISTURBANCE OF THE PIECE, CRIMINAL ACTION.

SO, UM, THOSE ARE THE SPECIFIC TYPES OF ACTIVITIES OR ACTIONS THAT WOULD BE DEEMED DISRUPTIVE UNDER THE BROWN ACT.
