ON, ON OCTOBER AND OCTOBER, 2019, GOVERNOR NEWSOME SIDE SB 13, AB 68, EIGHT, UM, AB SIX 70 AND AB EIGHT EIGHT ONE, WHICH PERTAINS TO ACCESSORY DWELLING UNITS TO ALLOW ACCESSORY DWELLING UNITS ON ALL RESIDENTIAL PROPERTIES ON ALL PROPERTIES DEVELOPED WITH RESIDENTIAL USES IN RESPONSE TO THIS, THESE BILL THAT THE GOVERNOR SIGNED, THE PLANNING COMMISSION INITIATED THE CODE AMENDMENT TO CHANGE OR AMEND THE CITY'S ORDINANCE PERTAINING TO ACCESSORY DWELLING UNITS SO THAT IT IS CONSISTENT OR TO STATE LAW ON DECEMBER 17, 2019, THE CITY COUNCIL ADOPTED AN URGENCY ORDINANCE SO THAT THE CITY CAN GAIN CONTROL SOME LOCAL CONTROL PERTAINING TO ACCESSORY DWELLING UNITS WITHIN THE INTENT WAS TO ADOPT URGENCY ORDINANCE AND LATER ON, GO BACK AND REVISE THE ORDINANCE SO THAT, UH, SO THAT THE CITY CAN MAKE CHANGES ACCORDING TO COMMENTS THAT WERE RECEIVED BY FROM, OR FROM THE STATE OF CALIFORNIA.

AND THEN, UM, AFTER THE ORDINANCE, THE URGENCY ORDINANCE WAS ADOPTED.

STAFF DID SEND A COPY OF THE URGENCY ORDINANCE TO THE STATE.

HOWEVER, THE STATE WAS NOT, UM, WAS NOT REVIEWING ORDINANCES FROM CITIES UNLESS THERE WERE COMMENTS RECEIVED FROM THE PUBLIC.

AND AT THAT TIME, THIS WEEK, A FEW RES A FEW RESIDENTS THAT WERE UNHAPPY WITH THE CITY'S CURRENT ORDINANCE CONTACTED THE STATE AND STAFF DID.

UM, STAFF DID SPEAK TO THE STATE OF CALIFORNIA HOW'S, UM, COMMUNITY HOUSING DEVELOPMENT, AND RECEIVED COMMENTS FROM THEM LAST MONTH.

AND SO THESE CHANGES TO THE DRAFT ORDINANCE ARE BASED ON COMMENTS RECEIVED FROM THE STATE PERTAINING TO THE CITY'S EXISTING ORDINANCE.

SO ON THE SCREEN RIGHT NOW IS DRAFT LANGUAGE ON SOME OF THE CHANGES THAT ARE, THAT ARE BEING PROPOSED.

THESE CHANGES ARE, ARE CHANGES, SO THAT THAT IS GOING TO BE MADE SO THAT IT IS CONSISTENT WITH STATE LAW.

NAMELY FOR THIS PARTICULAR SECTION, THE STATE SAID THAT CITIES CAN NOT LIMIT THE NUMBER OF BEDROOMS FOR ACCESSORY DWELLING UNITS.

SO WE ARE REMOVING THE TWO BEDROOM LIMITS FOR ACCESSORY DWELLING UNITS.

UM, AND ALSO THEY STATED THAT THERE IS, THERE ARE NO LIMITS ON HOW MANY SQUARE FEET, HOW MUCH SQUARE FOOT OR FEET AND 80 YOU CAN BE IF YOU'RE CONVERTING EXISTING FLOOR AREA INTO AN ACCESSORY DWELLING UNIT.

IN ADDITION, ALL PROPERTIES ARE ALLOWED TO HAVE AT LEAST A ONE 800 SQUARE FOOT ACCESSORY DWELLING UNIT ON, ON SITE.

UM, ANOTHER CHANGE, UM, THAT'S NOTLEY IS REGARDING RE ASSIGNING SEPARATE ADDRESSES.

OUR CURRENT CODE STATES THAT ACCESSORY DWELLING UNITS ARE, ARE AN ACCESSORY TO THE PRIMARY DWELLING UNITS.

AND A SEPARATE ADDRESS IS NOT ALLOWED FOR ACCESSORY DWELLING UNITS.

SO THIS IS GOING TO CHANGE SO THAT WE WILL, WE WILL ALLOW US A SEPARATE ADDRESS TO BE ASSIGNED TO ACCESSORY DWELLING UNITS.

IT'S MAINLY SO THAT THE PER THE OCCUPANTS OF THE ACCESSORY DWELLING UNIT IS ABLE TO RECEIVE MAIL BECAUSE IT IS ALLOWED TO BE RENTED OUT BY STATE LAW.

AND, BUT WE ARE STILL NOT ALLOWING THEM TO HAVE A SEPARATE UTILITY METER OR SHARED UTILITY OR, OR, AND THEY HAVE TO SHARE UTILITIES WITH THE PRIMARY USE SINCE IT IS STILL AN ACCESSORY TO THE PRIMARY USE.

UM, OTHER PROPOSED CHANGES ARE, WE ARE CLARIFYING THAT USE ARE ALLOWED ON ALL PROPERTIES DEVELOPED WITH RESIDENTIAL USES, AND IT, IT'S NOT JUST LIMITED TO RESIDENTIAL ZONING.

SO THERE ARE CERTAIN PROPERTIES LIKE PROPERTIES WITHIN THE DOWNTOWN PLAN AREA THAT IS NOT SPECIFICALLY ZONED AS RESIDENTIAL, BUT DOES ALLOW RESIDENTIAL USES.

SO IF IT'S DEVELOPED RESIDENTIAL USES, THEN AN ADU IS ALLOWED.

AND ACCORDING TO THE, THE CITY CANNOT REGULATE THE DESIGN OF THE ADU, WHICH MEANS THAT THEIR CURRENT CODE PERTAINING TO, TO THE WINDOWS AND DOORS BEING LOCATED AT LEAST 10

FEET AWAY FROM THE PROPERTY LINE AND THE FRONT DOOR NOT BEING ALLOWED TO BE LOCATED FACING THE STREET IS NOT ALLOWED.

ANOTHER, ANOTHER CHANGE IS THAT LENDERS ARE NOT REC ARE NO LONGER GOING TO BE REQUIRED TO SIGN COVENANTS, JUST THE PROPERTY OWNER.

AND WE ARE ALSO CLARIFYING THAT ACCESSORY DWELLING UNITS ON THE SECOND STORY, HE REQUIRED AN ADMINISTRATIVE USE PERMIT LIKE, UH, UM, OTHER TWO-STORY ADDITIONS IN ANY PROPERTY WITHIN THE CITY.

ALSO 80 USER, NOT SUBJECT TO AMERICANS WITH DISABILITY ACT REQUIREMENTS WITH THIS, IT IS RECOMMENDED THE PLANNING COMMISSION ADOPT RESOLUTION NUMBER 20 DASH 60 63, RECOMMENDING THAT THE CITY COUNCIL APPROVED THE ORDINANCE.

SO IT'S, IT'S BASICALLY SO THAT 80 USER NOT, NOT TREATED ANY DIFFERENTLY THAN AN ADDITION TO A HOUSE.

AND WE, IN ORDER TO REQUIRE THAT WE HAD, WE HAD TO SPECIFICALLY STATE THAT THAT APPLICATION IS REQUIRED.

IN 2003, HE APPLICATION IS OR A PRECISE PLAN FOR THE SITE DEVELOPMENT AND ARCHITECTURE OF THE PROJECT.

THE CONDITIONAL USE PERMIT IS FOR THE DRIVE-THROUGH AND THE ADMINISTRATIVE USE PERMIT IS FOR THE OUTDOOR DINING.

AND THE CURB IS 3,309.

AND THE CURB ONE, 125 PARKING SPACES, WHICH WOULD MEAN THAT THERE WOULD BE A SURPLUS SUR SURPLUS OF ONE 24 PARKING SPACES FOR THE EASTLAND AND 100 PARKING SPACES FOR THE CURB AREA ON THE PR PROJECTOR RIGHT NOW IS THE PROPOSED ELEVATION.

THE HEIGHT OF THE BUILDING AS MEASURED FROM THE HIGHEST POINT TO THE LOWEST GRADE, UM, WOULD BE AT THE, UM, AREA WHERE THEY CALL IT RATHER, THEY'RE CALLING THE JOLLY BEE TOWER ON THE, ON THE SITE, ON THE SET OF PLANS, BUT IT'S AT 25 FEET, FIVE INCHES.
